Terms of service

These terms apply to every order placed with M.Square Marine through m2marineletters.com. Orders placed in our Etsy shop are governed by Etsy's terms. Please read them — they are short, and the parts about the proof drawing and about custom goods matter.

1. Who you are dealing with

M.Square Marine, 418 Broadway, Ste N, Albany, NY 12207, United States. Email: msquare.marine.solutions@gmail.com. "We", "us" and "our" mean M.Square Marine; "you" means the person or business placing the order.

2. What we sell

Lettering cut to order from 316 marine-grade stainless steel, in the name, typeface, height and thickness you choose, together with a wooden mounting template cut to that lettering and printed fitting instructions. Adhesive is not included. Every set is made for one boat and has no other buyer.

3. How an order comes about

Placing an order is an offer to buy; our order confirmation email accepts it. We then prepare a dimensioned proof drawing of your lettering and email it to you. Nothing is cut until you reply approving the proof. Revisions before approval are free and unlimited. Until you approve the proof you may cancel for any reason and receive a full refund. Once you have approved it, production starts and the order can no longer be cancelled — see section 7.

If it turns out we cannot fulfil an order — because of an obvious pricing or description error, because we cannot ship to your address, or because we cannot make what was asked — we may cancel it, will tell you why, and will refund anything you have paid in full.

4. Your responsibilities when you approve

The proof shows exactly what we will cut: the spelling, the typeface, the height and the overall width. Please check the spelling letter by letter and measure the space on your boat against the width shown. You are responsible for the accuracy of what you approve. If your vessel is registered or documented, you are responsible for choosing a size, position and style that meets your flag state's marking rules (for example the United States Coast Guard's rules for documented vessels); we are glad to advise, but the choice is yours.

5. Prices and payment

Prices are in US dollars and are shown before you order, on the design page and at checkout. Shipping is included. For deliveries to the United States, import duties and taxes are included in the price. For deliveries elsewhere, import duty, VAT and customs charges are set by your own country and are not included; if they are due, your courier will collect them from you. Payment is taken in full at checkout through Shopify's checkout and its payment providers. Production does not start before payment is received.

Trade pricing is available to approved businesses through a trade account. Approval is at our discretion; trade prices show only when you are signed in to that account, are for your business's own use, and may be withdrawn if the account is shared or misused.

6. Making and delivery

We cut, polish and dispatch within 5 to 10 days of your proof approval, then ship tracked. Carriers and transit times are described in our Shipping policy, which forms part of these terms. Dates are our honest estimate, not a guarantee; if something will delay your order we will tell you. Please check your delivery address carefully — a parcel returned to us because of an incorrect address is re-sent at your cost. Risk in the goods passes to you on delivery.

7. Cancellation, returns and refunds

Because every set is made to your specification, there is no right to return it, or to a refund for change of mind, once you have approved the proof and cutting has begun. Under EU and UK consumer law the right of withdrawal does not apply to goods made to the consumer's specification or clearly personalised, and we rely on that exemption. Before proof approval you may cancel freely. If anything is wrong with what you receive — it does not match the approved proof, it is damaged or faulty, or it never arrives — we remake and reship at no cost. If the mistake was in the proof you approved, we re-cut at our cost price. Our Refund policy sets this out in full and forms part of these terms.

8. Warranty

We warrant our letters against corrosion for ten years from delivery under normal marine use, provided they are fitted as our instructions describe and cleaned with fresh water and a mild, non-abrasive cleaner. The warranty does not cover damage from impact or abrasion; from acidic, chlorinated or abrasive cleaners; from fitting against or together with dissimilar metals; or from adhesives or methods other than those we recommend. If a covered fault appears, we replace the affected letters free of charge; that is the remedy under the warranty. It is in addition to, and does not reduce, any rights you have under the consumer law of the country you live in.

9. Our liability

We are liable for what we are responsible for: the letters matching the approved proof, being free of defects, and arriving. To the extent the law allows, we are not liable for indirect or consequential losses — for example the cost of a haul-out, a missed launch date, a yard's labour, or the cost of fitting and removing letters — and our total liability for any order is limited to the price you paid for it. Nothing in these terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by our negligence, for fraud, or under mandatory consumer protection law.

10. Your design and our work

The name you give us is yours. The tools, drawings, typeface settings, photographs and text on this site are ours and may not be copied or reused without our written permission. We may photograph finished lettering before it ships and use those photographs, and any you send us of the letters fitted, to show our work; we never publish your personal details with them, and if you would rather your boat's name did not appear, tell us and it won't.

11. Accounts

If you open an account, keep your email account secure, because a one-time code sent to it is how you sign in. Tell us at once if you think someone else has used it. We may close an account that is used to abuse the site, our staff or other customers.

12. General

If part of these terms turns out to be unenforceable, the rest still applies. We may update these terms; the version in force when you order is the one that applies to that order. These terms and any order are governed by the laws of the State of New York, United States. If you are a consumer in the European Union or the United Kingdom, you also keep the protection of the mandatory consumer laws of the country you live in and may bring a claim in your own courts. If there is ever a dispute, please write to us first — we have always found a sensible answer, and we would rather keep it that way.
